2. PURPOSE

This Legal Notice governs access to and use of the website https://xalven.app and of the services KORNYX LLC provides through it (hereinafter, "the Site" and "the Service").

XALVEN is a commercial prospecting tool that makes it possible to find companies from public data sources and contact them by email from the user's own account.

Accessing the Site confers the status of user and implies acceptance of this Legal Notice. The contractual conditions of the Service are set out in the Terms of Use, and the processing of personal data in the Privacy Policy.

3. CONDITIONS OF USE

The user undertakes to use the Site and the Service in accordance with the law, this Legal Notice and the Terms of Use, and in particular to:

• Not use the Service for purposes contrary to applicable law, including data protection rules and those governing commercial communications.
• Not carry out actions that damage, overload or prevent the normal operation of the Site.
• Not attempt to access restricted areas, other users' data or the Service's systems without authorisation.
• Be answerable for the accuracy of the data provided and for safeguarding their access credentials.

The user is solely responsible for the content of the communications they send through the Service and for compliance with the rules applicable to such communications.

4. INTELLECTUAL AND INDUSTRIAL PROPERTY

The rights to the Site, the Service's software, its code, design, structure, texts, trade marks and logos belong to KORNYX LLC or to third parties who have authorised their use. No intellectual or industrial property right is assigned to the user beyond the use strictly necessary to use the Service in accordance with the Terms of Use.

Reproduction, distribution, public communication, transformation or decompilation of the Site or the Service without the owner's express written authorisation is prohibited.

The company data displayed comes from public sources and data providers; each retains its own terms of use and attribution requirements, indicated in the Privacy Policy and in the map interface.

5. DISCLAIMER

KORNYX LLC provides the Service with reasonable diligence, but:

• It does not guarantee uninterrupted availability of the Site or the absence of errors, without prejudice to the commitments assumed in the Terms of Use.
• It does not guarantee the accuracy, currency or completeness of the company data obtained from public sources and third-party providers.
• It is not liable for the use the user makes of the Service or for the content of the communications the user sends to third parties.

The Site may contain links to third-party sites. KORNYX LLC does not control those sites and is not responsible for their content.

6. DATA PROTECTION

The processing of personal data is governed by the Privacy Policy and, as regards cookies, by the Cookie Policy. Users may exercise their rights through the GDPR rights form or by writing to support@xalven.app.

7. GOVERNING LAW AND JURISDICTION

This Legal Notice is governed by the laws of the State of Wyoming (United States), without regard to its conflict-of-law rules, and by the Spanish and European rules that are mandatorily applicable because services are provided to users located in Spain and the European Union, including the LSSI-CE.

Consumers resident in the European Union or the European Economic Area retain the protection afforded by the mandatory provisions of the law of their country of habitual residence and the possibility of bringing proceedings before the courts of their domicile. In all other cases, the jurisdiction set out in section 11 of the Terms of Use applies.
